Lawmakers launch budget talks as Washington returns to work

WASHINGTON (Reuters) - U.S. lawmakers launched an effort to resolve budget differences in a less confrontational fashion on Thursday as Washington picked up the pieces from a political crisis that has slowed the economy and undermined the country's international standing.

As hundreds of thousands of federal employees returned to work, Republican and Democratic negotiators held their first meeting to tackle tax and spending issues that have led to repeated rounds of brinkmanship over the past three years.

But one day after Congress ended a 16-day government shutdown and stepped back from the edge of an unprecedented debt default, many feared that they have only set the stage for another standoff in the months to come.

"I just hope we don't have to go through this again in two months," said Sandria Coombs, a contractor at the Environmental Protection Agency who was furloughed.

The last minute budget deal, signed into law by President Barack Obama just after midnight, restores government funding through January 15 and extends its borrowing authority through February 7, though the Treasury Department might be able to stave off a default for several weeks past that point.

Speaking at the White House, Obama urged lawmakers to turn to more productive work. He suggested an ambitious agenda including an overhaul the country's immigration program by the end of the year and resolution of long-term budget issues. He also called for final work on a farm bill that had been sidelined by the fiscal confrontation.

"Let's work together to make government work better instead of treating it like an enemy," he said.

On Capitol Hill, budget negotiators pledged to bridge the vast gulf between Republican and Democratic fiscal priorities. The panel is supposed to reach agreement by December 13, but there are no guarantees it will succeed where similar efforts have failed.

The standoff ended with a clear defeat for Republicans, who had sought to tie government funding to measures that would undercut Obama's signature Affordable Care Act.

That effort failed, and the standoff diverted public attention away from the administration's sloppy rollout of the health law's online insurance exchanges.

The fight split business-friendly Republicans from grassroots Tea Party conservatives and left the party on the wrong side of public opinion. Though Obama's approval rating fell during the crisis, polls showed that most voters blamed Republicans for the standoff.

A Pew Research Center poll found that 49 percent of Americans now have a negative view of the Tea Party, a new low. But Tea Party groups remained unbowed: several on Thursday endorsed a conservative primary challenger to Mississippi Republican Senator Thad Cochran, who is up for reelection next year.

Republican Representative Tom Cole from Oklahoma, who sits on the budget panel, said it is time to move on. "We've had the fight," he said on MSNBC. "Now it's time to get down and identify the things we can agree on."

U.S. stocks gained on Thursday with the S&P 500 index hitting a record intraday high. The index fell as much as 4 percent during the standoff but recovered as a deal emerged.

WORKERS RETURN

Hundreds of thousands of federal workers who had been idled by the standoff returned to work. Vice President Joe Biden brought muffins to returning workers at the Environmental Protection Agency, while Agriculture Secretary Tom Vilsack greeted workers returning to the agency's headquarters on the National Mall.

Though federal workers will get back pay, the standoff is likely to slow economic growth in the fourth quarter from 2.5 percent to 2.3 percent with a high risk that it could slow even further, according a Reuters survey of 70 economists.

"The insanity in Washington is affecting consumer and business confidence. That's the huge restraint to growth," said Joel Naroff, chief economist at Naroff Economic Advisors in Holland, Pennsylvania.

The standoff has elevated borrowing costs, caused private-sector furloughs and delayed mortgage applications and construction permits. Mark Zandi, chief economist of Moody's Analytics, estimates that it will cost the economy $20 billion.

The last debt-ceiling fight in 2011 depressed consumer confidence for months and raised the United States' borrowing costs by $19 billion over 10 years.

The United States' once-perfect credit rating has been dented by the repeated confrontations. Standard and Poor's downgraded U.S. debt following the 2011 crisis, while Fitch warned on Tuesday that it may cut its assessment as well.

The third major rating agency, Moody's, said on Thursday it would maintain its AAA rating.

One possible upside: the turbulence could prompt the Federal Reserve to keep its massive monetary stimulus in place through next year. One Fed official said the deadlock has undermined the central bank's ability to fight high unemployment.

"Kicking the can down the road for a few months will not solve the pathology of fiscal misfeasance that undermines our economy and threatens our future," Dallas Fed President Richard Fisher told the Economic Club of New York.

Economists say the spending cuts and tax hikes approved by Congress over the past several years have elevated the unemployment rate even as they have helped the country narrow budget deficits.

The deal approved Wednesday is likely to cause more short-term pain by keeping the across-the-board "sequester" cuts in place. Officials at the Pentagon and other federal agencies that have been able to minimize the impact of the cuts so far say they will slice deeper in the months to come.

New Jersey voters head to polls in U.S. Senate special election


NEW YORK (Reuters) - Cory Booker, the charismatic mayor of New Jersey's largest city, is heavily favored to beat conservative activist Steve Lonegan when voters head to the polls on Wednesday in a special election to fill New Jersey's vacant U.S. Senate seat.


A Quinnipiac poll on Tuesday found Booker, the Democrat mayor of Newark, ahead of Republican Lonegan, a former small-town mayor with limited name recognition but a flair for attention-grabbing events, by a margin of 54 to 40 percent.


David Redlawsk, the director of the Eagleton poll, which in a poll released on Monday gave Booker a 58 to 36 percent lead over Lonegan, said the race will come down to turn-out.


"Here's the key: if the Booker campaign can turn out urban voters and Democrats who say they will vote, he will be in the range we estimate," said Redlawsk.


In recent weeks, Lonegan, the former state director of Americans for Prosperity, a group funded by the conservative Koch brothers, has appeared to close in on Booker.


But after a series of debate performances in which Lonegan touted his conservatism, applauding Republicans in government for their role in the federal government's shutdown, Booker began to rebound.


"The debates presented a stark picture of the differences between the candidates, which appears to have led independents to prefer Booker," said Redlawsk.


For a time, it was thought that Booker would challenge the state's Republican governor, Chris Christie, who is up for re-election in November. But Christie's popularity has remained high since superstorm Sandy crashed into the Jersey Shore last October.


Instead, last December, Booker said he was exploring a bid for the U.S. Senate seat occupied by Frank Lautenberg, a Democrat. A month later, Lautenberg announced he would retire.


In June, Lautenberg died of pneumonia and Christie called a special election to fill the seat.


Booker, a Rhodes scholar and Yale Law School graduate who was first elected Newark mayor in 2006, rocketed to fame as a booster for a city 12 miles from Manhattan that was struggling with a persistently high crime.


Booker's first run for mayor was documented in the Oscar-nominated film "Street Fight," and he is known for rubbing shoulders with celebrities.


Lonegan, who unsuccessfully challenged Christie in the 2009 Republican gubernatorial primary, has dubbed Booker a "Hollywood wannabe" more concerned with his own celebrity than with governing.

Report: NSA Harvests Contact Lists From Email, Facebook


The Washington Post has published new revelations about the National Security Agency's electronic snooping, indicating that the intelligence branch gathers millions of contact lists from personal email accounts and instant messaging around the world.


The new information is attributed by the Post to "senior intelligence officials and top-secret documents provided by former NSA contractor Edward Snowden."


The Post reports:




"The collection program, which has not been disclosed before, intercepts e-mail address books and 'buddy lists' from instant messaging services as they move across global data links. Online services often transmit those contacts when a user logs on, composes a message, or synchronizes a computer or mobile device with information stored on remote servers.


Rather than targeting individual users, the NSA is gathering contact lists in large numbers that amount to a sizable fraction of the world's e-mail and instant messaging accounts. Analysis of that data enables the agency to search for hidden connections and to map relationships within a much smaller universe of foreign intelligence targets."




According to the newspaper, in a single day last year the NSA harvested 444,743 email address books from Yahoo, 105,068 from Hotmail, 82,857 from Facebook, 33,697 from Gmail and 22,881 from unspecified other providers.


The Post story quotes Yahoo as saying in response to NSA effort, it would begin encrypting user connections using SLL technology in January.


However, last month, The Two-Way's Eyder Peralta wrote that The New York Times and The Guardian, relying on documents from Snowden, revealed that the NSA has the keys to crack most Internet encryption methods.




"In plain English, this means that many of the tools — like , used by many banks and email providers — that people worldwide have come to believe protect them from snooping by criminals and governments are essentially worthless when it comes to the NSA."

Nicollette Sheridan's case over firing dismissed

LOS ANGELES (AP) — A judge on Friday dismissed Nicollette Sheridan's long-running wrongful termination lawsuit against ABC over her ouster from the hit television series "Desperate Housewives."


Without ruling on the facts of the case, Superior Court Judge Michael Stern determined the actress should have exhausted her claims to a labor commissioner before pursuing a trial.


The ruling stalled Sheridan's push for a retrial on claims filed in 2010 that she was fired after she complained that show creator Marc Cherry struck her on the head on the set in 2008.


Last year, a jury deadlocked 8-4 in favor of a Sheridan lawsuit alleging ABC had retaliated against her and cut her Edie Britt character due to her complaints about Cherry.


ABC denied it fired Sheridan or retaliated against her. Cherry and several executives with the show and the company previously testified that the decision to kill off the role was made before the incident with Cherry.


Cherry denied hitting the actress, claiming he tapped her on the head for artistic direction.


"It's the right result," ABC's attorney Adam Levin said after the hearing.


David Crochetiere, an attorney for Sheridan, said the ruling would be appealed. He noted that a majority of jurors sided with Sheridan in a two-week trial that focused on the behind-the-scenes intrigue and personalities involved in "Desperate Housewives."


Sheridan had been seeking roughly $6 million from her former employers.


An appeals court ruled in August 2012 that ABC and Touchstone Television hadn't wrongfully terminated Sheridan from the show. However, the ruling allowed her to keep pursuing retaliation claims.

'Voice' coaches fight for 'Big Bang' star's sis

Team Christina's Jacquie Lee and Briana Cuoco battle it out on "The Voice."

"The Voice's" universe was in a hot dense state Monday night, when two coaches fought to keep Briana Cuoco, the younger sister of "Big Bang Theory" star Kaley Cuoco. 

The Battle Rounds are all about the steals, and Christina Aguilera started the fracas when she picked Jacquie Lee over Cuoco (thus costing her any chance at a guest gig as Penny's long-lost cousin on the hit CBS sitcom). In response, both CeeLo Green and Blake Shelton pushed their buttons.

CeeLo spoke first. "I believe that there's a story in your voice and I want to help nurture your niche, so I think you could do very well here on Team CeeLo," he said. Then he turned to Blake and said, "Beat that."

That got Adam Levine cheering — but sadly for him, Blake could, indeed, beat that. And without even bringing his A game.

"I have a feeling how you performed that song that you're probably a songwriter, and how you really connect with the lyrics like that, it's almost as possible not to be," he said.

What? What kind of sales pitch is that?! That's not a desperate plea — it's a statement of fact. But it was enough for Cuoco, even though CeeLo had also pushed for her at the blind auditions.

"I wanted to steal Briana because I think that she can shape-shift so to speak and be different things. But I got other steals, and I got other chicks up my short sleeves," CeeLo said.

Aw, CeeLo. Don't be mad. Maybe you can at least get the consolation prize and write a new "Big Bang Theory" theme song to replace the Barenaked Ladies version. After all, it's not like they ever tried to help Cuoco's singing career.

"Why is Adam such an idiot?"
Blake now has to wait until the Knockout Rounds before he can push his button again. He'd previously started the night off by swiping Nic Hawk from Adam after Nic lost his sing-along to wedding singer Grey.

"Aw, Adam, you screwed up so bad!" Blake said once the results were announced, causing Nic to break down in tears.

"Why are you stealing Nic Hawk?" host Carson Daly asked.

"Why is Adam such an idiot?" Blake replied. "Why don't you ask me that?"

"You delivered an excellent vocal performance and you did all that other crap that you do," Blake then told Nic. "Will you teach me how to dance?"

"Hell yeah, I'll teach you how to dance," Nic said.

That might be a tougher task than winning "The Voice" — but it'll definitely be an interesting pairing to watch going forward.

"If there ever was an odd couple, it's me and Nic," said Blake. "I think this is gonna be a lot of fun."

Love for Anthony
The other contender for top battle of the night was from Team CeeLo, with Anthony Paul taking on Caroline Pennell in a duet of "As Long As You Love Me." The song may be Justin Bieber, but the dark arrangement suited Caroline's unique vocal stylings and caused CeeLo to get downright poetic in his praise.

"There's something so surreal about your voice," he said. "It encourages me to dream with my eyes open."

"CeeLo! I love that line," responded Christina. "That's beautiful," 

Maybe that swayed her heart, because after CeeLo picked Caroline and urged the other judges, "Steal him … someone!" Christina pushed her button and got him.

"Christina stole Anthony, and it's bittersweet. I think that I was wrong pairing them together," CeeLo said.

Cher + Adam?
Blake and guest mentor Cher only had one battle on Monday's show, but it was enough to make Blake a little jealous of one of his fellow coaches.

Blake urged both Justin Chain and Shelbie Z to bring their best to their battle, noting how much Adam would love to steal one of his country singers. 

"I love Adam!" Cher said.

"Oh you do?" Blake said, then challenged, "What's your favorite song he does?"

That gave Cher pause. "Oh, they're all so good," she said.

So maybe she doesn't have any Maroon 5 songs on her iPod. But that might explain why Blake stole Nic, who said at the auditions that Adam might be too good-looking to work with. Best to keep those with a crush on his fellow coach nearby.

But Adam didn't return the favor by stealing Justin, and the country crooner went home after Blake stuck with Shelbie.

Sarah Kaufman: The silent, violent showstopper

One of the greatest fights of 2012 came on the same fight card as one of the most memorable. Sarah Kaufman and Alexis Davis fought in Columbus in March of that year, a Strikeforce event that was headlined by Ronda Rousey and Miesha Tate. Everyone remembers Rousey contorting Tate’s arm into alarming states of disfigurement en-route to winning the bantamweight belt.

Less remembered was the ridiculous fight Kaufman gave Davis (and vice-versa).

In the encounter, the former bantamweight champion Kaufman and Davis stood toe-to-toe and traded dukes, kicks and elbows, tossed, rag-dolled, and strafed each other, clawed, kneed and pummeled one another to the edge of physical endurance. It wasn’t the tired old clichĂ© of Bonnar-Griffin, which was the right fight at the right time; it was quieter due to its placement. This was two smiling forward-moving heathens doing it for the joy of fighting. It was clear that both Davis and Kaufman were enjoying themselves capitally from bell to bell.

As Kaufman gets set to make her UFC debut on Saturday night in Houston against Jessica Eye, the British Columbian war horse wouldn’t mind giving the fans another hissing live wire of a fight like that one with Davis. Or even Leslie Smith, who was her latest casualty from the Invicta cage last April.

The only thing she needs is an accommodating opponent.

"Honestly, with both Alexis and Leslie, we all have such similar styles we all like to get in there and throw down, and those are the fights I like," Kaufman told MMA Fighting. "To me that’s fun. Getting hit, hitting back, having that challenge of who can go longer and faster and harder…those are the fights I love. And the fans love them, too.

"Those are the fights you make your name off of. Granted, if I got a five-second knockout, how happy would I be? Wee, happy! But I also love feeling when I leave like I was in a fight."

If Kaufman isn’t shotgun to the UFC’s bantamweight title, she’s at least in the vehicle. She defeated Miesha Tate -- who will get her rematch with Rousey at UFC 168 in December -- back in 2009. So there’s leverage for a title push were she to get past Eye.

But it’s complicated in the new wilderness of the women’s bantamweight division. Kaufman already fought Rousey in August 2012 and lost via armbar in less than a minute. That loss exists on historical record, even if the UFC doesn’t like to carry over history from other promotions (even the ones Zuffa owns). And then there’s the hovering presence of Cat Zingano, who was supposed to be in the contender’s seat right now before a knee injury forced her to the sidelines.

Where Kaufman sits in the division is…somewhere near the top.

"I could see with a good win [over Eye], depending on when Cat Zingano is back, giving me a fight with Cat, or giving me a title shot right away," Kaufman says. "I’ve already fought Liz Carmouche. I’ve already fought Alexis Davis. I’ve already fought Miesha Tate. But, honestly, I feel like Cat Zingano would be a pretty interesting fight for that next shot at the title."

Not that she’s looking past Eye, who is coming off a victory over Carina Damm and is riding a seven-fight winning streak overall. Eye is also making her UFC debut, and has looked better each time out in her NAAFS and Bellator bouts.

"I think she’s a great opponent, and that it’s a very exciting fight for the fans – and it’s a very exciting fight for me," Kaufman says. "It’s going to get me in there and give me the opportunity to let loose a little bit, and have some fun. By ‘have fun’ I mean serious and focused, but I like fighting. I don’t like to have to worry too much about, what if they try and stall the fight to wrestle me down? Or whatever the case may be. I like those exciting fights and the opportunity to let loose. It’s what I like to do -- let loose and have fun in the cage."

Kaufman was supposed to have made her UFC debut in August against Sarah McMann, but McMann was forced to pull out with a personal issue. She calls the bait-and-switch "very frustrating," though she’s had enough experience in the spotlight to know how to roll with the punches.

"If five people are watching, or if five million people are watching, I want to perform the same," she says. "I’m ready. I’ve performed at some of the biggest stages of the world already, and so this is the next step up for me."

SoftBank to take 57 percent stake in phone distributor Brightstar for $1.26 billion

Stake in company to grow to 70 percent over next five years

After purchasing a majority stake in Sprint earlier this year, Japanese carrier SoftBank is eyeing an investment in U.S. phone distributor Brightstar. The deal will see SoftBank take a 57 percent stake in the company for $1.26 billion in cash, and has already been approved by SoftBank's board. Brightstar is a name you may not have heard of before, but is one of the biggest phone distributors (acting between manufacturers and retailers) with a presence in over 50 countries worldwide.

The deal will make Brightstar the exclusive distributor of handsets to some SoftBank affiliates, presumably including Sprint here in the U.S. Along with its investment in Sprint, SoftBank's stake in Brightstar could give it a better foothold on securing the latest devices for its carriers. The deal is still in need of regulatory approval, but is expected to close by the end of 2013, the companies said.

Tesla's Elon Musk Revealed as James Bond Submarine Car Buyer


The winning bidder for the Lotus Esprit featured in the underwater sequence in The Spy Who Loved Me that sold at auction in London last month has been identified as Elon Musk, the futurist and Tesla Motors CEO. 



According to Jalopnik, Musk and another buyer engaged in a heated bidding war before Musk landed the submersible Esprit for $968,000. A longtime car enthusiast, Musk is said to have based the design of the first Tesla on the Lotus Elise. Tesla PR also told the car blog that Musk plans to add a Tesla drive train to the car and will attempt to make it transform into a working submarine.


"It was amazing as a little kid in South Africa to watch James Bond in The Spy Who Loved Me drive his Lotus Esprit off a pier, press a button and have it transform into a submarine underwater. I was disappointed to learn that it can't actually transform," Musk said. "What I'm going to do is upgrade it with a Tesla electric powertrain and try to make it transform for real."


The James Bond car was discovered covered in blankets in 1989 by a Long Island building contractor in a storage container purchased for $100. 


The Ian Fleming Foundation later authenticated the car as the vehicle used in the movie. It had been placed in storage after the film was released and remained there for 10 years until the storage fee was forfeited. The contractor who purchased the container at first had no idea that the car was the same one used in the Bond movie.

In The Spy Who Loved MeRoger Moore, as 007, under pursuit from a helicopter, drives the car off the end of a pier into the sea. The Lotus retracts its wheels, sprouts stabilizers and rudders, and skims just below the water's surface.


"I believe it's time we've said goodbye to an uninvited guest," Moore tells the nonplussed Barbara Bach, riding shotgun. When Moore presses a button on the dashboard, a missile streaks from the car, destroying the helicopter.


This was the first time the Esprit had been offered for sale since its discovery. The 1964 Aston Martin DB5 used in Goldfinger and Thunderball sold for $4.6 million in 2010.

A lot of people speculated that Miley took the broken engagement pretty hard. But, not so, according to a Miley “pal” who might also be her press agent:



The Liam thing shook her up a bit, but she’s over it now. She has thrown herself into work and she knows that it’s for the best. She’s proved that she doesn’t need Liam to be happy or successful. The past few months have been incredibly empowering for her.”



By empowering I suppose she means taking off her clothes in public and demanding her daddy see how much men like her now. That all seems so complicated and makes me happy to not be a girl.

American Express' 3rd-qtr profit rises 9 percent

LOS ANGELES (AP) — American Express says its net income rose 9 percent in the third quarter, as cardholders spent more in the U.S. and elsewhere. The results trumped Wall Street estimates.


The New York-based company said Wednesday that spending on its global network jumped 7 percent in the June-September period. It also benefited from growth in income from interest charges, as well as card loans.


American Express cardholders tend to be more affluent than other credit card users, which is one reason the company has done well as the nation's economy has gradually improved despite a sluggish global economy.


Unlike Visa and MasterCard, which only process transactions, American Express issues its own cards. When cardholders charge more on their AmEx cards, the company earns even more in interest income and a variety of fees.


For the three months ended Sept. 30, American Express reported net income of $1.36 billion, or $1.25 per share. That compares with net income of $1.25 billion, or $1.09 per share, in the same period last year.


Revenue increased about 6 percent to $8.3 billion, from about $7.86 billion.


Analysts polled by FactSet were expecting, on average, earnings of $1.22 per share on revenue of $8.23 billion.


Shares in American Express ended regular trading up $1.07 at $76.32. The stock added 23 cents to $76.55 in extended trading.

Uneven enforcement suspected at nuclear plants

BOSTON (AP) — The number of safety violations at U.S. nuclear power plants varies dramatically from region to region, pointing to inconsistent enforcement in an industry now operating mostly beyond its original 40-year licenses, according to a congressional study awaiting release.


Nuclear Regulatory Commission figures cited in the Government Accountability Office report show that while the West has the fewest reactors, it had the most lower-level violations from 2000 to 2012 — more than 2½ times the Southeast's rate per reactor.


The Southeast, with the most reactors of the NRC's four regions, had the fewest such violations, according to the report, a copy of which was obtained by The Associated Press.


The striking variations do not appear to reflect real differences in reactor performance. Instead, the report says, the differences suggest that regulators interpret rules and guidelines differently among regions, perhaps because lower-level violations get limited review.


The study also says that the NRC's West region may enforce the rules more aggressively and that common corporate ownership of multiple plants may help bolster maintenance in the Southeast.


However, the reasons aren't fully understood because the NRC has never fully studied them, the report says. Right now, its authors wrote, the "NRC cannot ensure that oversight efforts are objective and consistent."


Told of the findings, safety critics said enforcement is too arbitrary and regulators may be missing violations. The nuclear industry has also voiced concern about the inconsistencies, the report said.


The analysis was written by the GAO, the investigative arm of Congress, at the request of four senators. Before the government shutdown, the report had been set for public release later this month.


Steven Kerekes, a spokesman for the industry group Nuclear Energy Institute, declined to comment pending release of the report. The NRC's public affairs office had no comment, citing the government shutdown.


The GAO analysis focuses on lower-level safety violations known as "nonescalated." They represent 98 percent of all violations identified by the NRC, which regulates safety at the country's commercial reactors.


Lower-level violations are those considered to pose very low risk, such as improper upkeep of an electrical transformer or failure to analyze a problem with no impact on a system's operation, such as the effect of a pipe break. Higher-level violations range from low to high safety significance, such as an improperly maintained electrical system that caused a fire and affected a plant's ability to shut down safely.


The GAO's analysis shows 3,225 of these violations from 2000 through the end of 2012 across 21 reactors in the West. By contrast, there were 1,885 such violations in the Southeast. Yet that region is home to 33 reactors — 12 more than in the West. The West registered 153.6 violations per reactor, while the Southeast saw just 57.1.


The Midwest, with 24 reactors, had 3,148 violations, for a rate of 131.2 per reactor. The 26-reactor Northeast also fared worse than the Southeast, with 2,518 violations, or 96.8 per reactor.


The Cooper nuclear station in Brownville, Neb., led all sites in lower-level violations per reactor with 363. The next four were Wolf Creek, in Burlington, Kan., with 266; Kewaunee, in Kewaunee, Wis., 256; Perry, in Perry, Ohio, 256; and River Bend, in St. Francisville, La., 240.


The GAO found less regional variation in higher-level safety violations. The six plants with the most higher-level violations per reactor from 2000 to 2012 were Davis-Besse in Oak Harbor, Ohio, with 14; Cooper, 11; Kewaunee, nine; Perry, eight; Palisades, in Covert, Mich., eight; and Fort Calhoun, in Fort Calhoun, Neb., eight.


"I believe the oversight process is totally arbitrary," said Paul Blanch, an engineer who once blew the whistle on problems from within the industry and later returned to work on safety. He also said the NRC isn't providing consistent training to inspectors and regional staff. Blanch was made aware of the GAO findings by the AP.


The report also indicates that some regulators may be missing small problems or giving them short shrift, safety experts said. And they said little violations can pile up and interact with one another to create bigger risks.


"Any time you start tolerating minor problems, you're just setting the stage for major safety problems down the road," said nuclear engineer David Lochbaum of the Union of Concerned Scientists. He once trained NRC staff.


Phillip Musegaas, a lawyer with the environmental group Riverkeeper, said regulators should do more to make sure that lower-level violations are fixed. "NRC's tracking to make sure these violations are resolved is completely ineffectual," he said.


In its official response to the report, the NRC defended the objectivity of its plant assessments. At the same time, it acknowledged the regional differences and promised to look deeper into why they happen.


According to the GAO, the NRC regulatory staff also offered several explanations, including regional variations in reactor ages and time spent on inspections. However, the congressional watchdog said those explanations are not supported by the data.


The agency did offer that regulators may be right when they cite the possible impact of joint ownership of sites, a circumstance most prevalent in the Southeast. Nuclear plants under one owner may benefit from more corporate resources and thus avoid violations, the GAO suggested. The NRC also said higher-level violations are more consistent because they are more deeply reviewed.


On other issues, the report said the NRC needs an easier-to-use internal database to help staff learn of historical safety issues that apply to current problems. It also pressed the agency to improve its public documents website to allow tracking of safety violations. The NRC said it would work to improve both tools.


Senators requested the report in reaction to the Japanese nuclear accident at Fukushima in 2011 and an Associated Press investigative series later that year about aging U.S. nuclear plants. The AP series found that federal regulators had relaxed safety rules to keep plants running beyond their initial licenses. It also reported leaks of radioactive tritium at three-quarters of plants and outdated estimates of evacuation times.


The GAO analyzed data for 104 commercial reactors, but four permanently shut earlier this year: Crystal River in Florida, Kewaunee, and the two units at San Onofre in California.

Lao Airliner Crash That Killed 49 Blamed On Bad Weather

The crash of a turboprop in southern Laos that killed all 49 people aboard was caused by a violent storm that prompted the pilot to miss a runway and careen into the Mekong River, authorities say.


"Upon preparing to land at Pakse Airport the aircraft ran into extreme bad weather conditions and was reportedly crashed into the Mekong River," the Laos Ministry of Public Works and Transport said in a statement.


The Lao Airlines' ATR-72 had 44 passengers aboard. In addition to 17 Lao nationals, the flight included several passengers from France, Australia and Thailand; three from Korea; two from Vietnam; and one person each from the United States, Canada, Malaysia, China and Taiwan. Five crew members were also killed.


The state-run news agency of Laos quoted an eyewitness to the crash as saying that the plane "appeared to be hit by a strong wind, causing its head to ascend and pushing it away from the airport area."


The Bangkok Post reports that one of the plane's propellers, as well as passengers' backpacks and passports, were among the debris in the Mekong River:




" 'So far eight bodies have been found. We don't yet know their nationalities,' said Yakao Lopangkao, director-general of Lao's Department of Civil Aviation, who was at the crash site in Pakse, the main town in the southern Lao province of Champassak. 'We haven't found the plane yet. It is underwater. We're trying to use divers to locate it.'


"He ruled out finding survivors. 'There is no hope. The plane appears to have crashed very hard before entering the water.' "




According to The Sydney Morning Herald:




"Lao Airlines, the national airline of the impoverished and landlocked nation of six million people, operates domestic as well as international services. Its fleet includes six aircraft of the type involved in the crash.


"Paske, the capital of Champasak province, opposite the Thai province of Ubon Ratchathani, is the largest city in southern Laos.


"The area is a popular destination for tourists who visit coffee plantations of the Bolaven Plateau and a former royal principality."

Director Bay attacked on 'Transformers' set in HK

HONG KONG (AP) — Hollywood director Michael Bay was attacked and slightly injured Thursday on the set of the fourth installment of the "Transformers" movie series currently filming in Hong Kong, police said.


A Hong Kong police spokeswoman said two brothers surnamed Mak who own a shop near the movie set approached Bay and demanded 100,000 Hong Kong dollars ($13,000).


When Bay refused to pay, they assaulted him, she said. The brothers also allegedly assaulted three police officers who were called to the set.


The spokeswoman said Bay suffered a minor injury to his face but declined medical treatment. She spoke on customary condition of anonymity.


The two men, aged 27 and 28, were arrested and face charges of blackmail, assault and assaulting police officers, she said.


Paramount Pictures gave a somewhat different account of the incident, which it said occurred on the film's first day of production in Hong Kong.


It said in a statement that a man allegedly under the influence of a narcotic substance rushed onto the set wielding an air conditioning unit and swung it at Bay's head. It said Bay ducked and wrestled the air conditioning unit away from the man.


Police arrested the man and two companions, and no one on the set was injured, Paramount said.


"Transformers 4: Age of Extinction" is partly set in Hong Kong. It stars Mark Wahlberg and is to be released next June.

Bodies recovered in Mekong after Laos plane crash

PAKSE, Laos (AP) — Rescuers in fishing boats pulled bodies from the muddy Mekong River on Thursday as officials in Laos ruled out finding survivors from a plane that crashed in stormy weather, killing 49 people from 10 countries.


Backpacks, two broken propellers and passports were among the debris scattered on the riverbank where the Lao Airlines turboprop plane left deep skid marks in the ground before disappearing into the water Wednesday.


Thai Foreign Ministry spokesman Sek Wannamethee said search teams had recovered the bodies of 15 crash victims by the time their operations ended Thursday because of darkness and the strong current. He said they were unable to immediately identify them. The last official count issued by Laos of bodies retrieved gave a lower number, nine.


Thailand, which lost five nationals in the crash, is deeply involved in the search, providing skilled manpower and technology that its poorer neighbor lacks.


Yakao Lopangkao, director-general of Lao's Department of Civil Aviation, who was at the crash site in Pakse in southern Laos, ruled out finding survivors.


"There is no hope," he said. "The plane appears to have crashed very hard before entering the water."


He said the plane's fuselage had not yet been found, but was underwater and divers were trying to locate it.


Some of the bodies were found by fishermen floating downstream as far as 20 kilometers (12 miles) from the crash site, he said.


"We have asked villagers and people who live along the river to look for bodies and alert authorities when they see anything," he said.


Fleets of small boats and inflatable rafts plied the muddy, vast waterway as part of the search, with men in life vests peering into the water. After storms Wednesday, the search took place under sunny blue skies.


State-run Lao Airlines released a second updated list of the 44 passengers' nationalities on Thursday. It said the flight included 16 Lao nationals, seven French, six Australians, five Thais, three Koreans, three Vietnamese and one person each from China, Malaysia, Taiwan and the United States. A person who had been listed as a Canadian was instead added to the list of Vietnamese.


The passengers included foreign tourists and expatriates working in Laos.


Tourism has become a major source of income for Laos in the past decade. In 2012, the country received more than 3.3 million foreign tourists who generated total revenue of more than $513 million.


The area where the plane crashed is off the main tourist circuit in Laos but known for its remote Buddhist temples, nature treks and waterfalls.


Cambodian authorities said one of the plane's pilots was a 56-year-old Cambodian with more than 30 years' flying experience.


Details of the crash remained murky. Lao Airlines said in a statement Wednesday that the plane took off from the capital, Vientiane, and "ran into extreme bad weather conditions" as it prepared to land at Pakse Airport. The crash occurred about 7 kilometers (4 miles) from the airport.


The airline said it had yet to determine the cause of the crash of the ATR-72 aircraft, which had been delivered in March.


French-Italian aircraft manufacturer ATR said in a statement that "the circumstances of the accident are still being determined." It said that it would assist in the investigation, which will be led by Lao authorities.


It was the first fatal crash for Laos' state carrier since 2000, when two separate crashes left 23 people dead.


The ATR-72 has been involved in 16 crashes since it went into service in 1988, according to databases kept by the Flight Safety Foundation and the Bureau of Aircraft Accidents Archives. The death toll from Wednesday's crash was the third highest on record involving an ATR-72; accidents in the U.S. in 1988 and Cuba in 2010 each killed 68 people. ATR had delivered 611 of the planes by the end of last year.


Among the six Australians on board was a family of four. Relatives released a photo of the family, Gavin and Phoumalaysy Rhodes and their two children, a 3-year-old girl and a 17-month-old boy.


The other two Australians were a father and son. They were identified as Michael Creighton, a 42-year-old aid worker based in Laos who had worked for the United Nations, and his father, Gordon Creighton, 71, a retired teacher who was visiting his son.


"We have lost a father, a husband, a son, a brother, a fiance and a best mate in one tragic circumstance and we are trying to come to terms with our loss," the family said in a statement. Michael Creighton was living in Laos with his fiancee, who was not on the plane.


Lao Airlines was founded in 1976 after the communist takeover of Laos, operating under the name Lao Aviation until a rebranding in 2003. It originally operated with Chinese- and Soviet-built aircraft, which were replaced in the mid-1990s as part of a major upgrade that included the purchase of ATR turboprops and in 2011 the delivery of two Airbus A320 aircraft.

Senate deal on debt, shutdown sends stocks soaring

NEW YORK (AP) — Wall Street finally got the deal it's been waiting for.


A last-minute agreement to keep the U.S. from defaulting on its debt and reopen the government sent the stock market soaring Wednesday, lifting the Standard & Poor's 500 index close to a record high.


The deal was reached just hours before a deadline to raise the nation's $16.7 trillion debt limit. Senate leaders agreed to extend government borrowing through Feb. 7 and to fund the government through Jan. 15.


The agreement follows a month of political gridlock that threatened to make America a deadbeat and derail global markets, which depend on the U.S. to pay its bills. American government debt is widely considered the world's safest investment.


Markets stayed largely calm throughout the drama in Washington, with the S&P 500 actually gaining 2.4 percent since the shutdown began Oct. 1, after House Republicans demanded changes to President Barack Obama's health care law before passing a budget.


Wall Street gambled that politicians wouldn't let the U.S. default, a calamity economists said could paralyze lending and push the economy into another recession.


"We knew it was going to be dramatic, but the consequences of a U.S. default are just so severe that the base case was always that a compromise was going to be reached," said Tom Franks, a managing director at TIAA CREF, a large retirement funds manager.


Congress was racing to pass the legislation before the Thursday deadline.


If the deal wraps up soon, investors can turn their attention back to economic basics like third-quarter earnings. Overall earnings at companies in the S&P 500 index are forecast to grow 3.1 percent from a year earlier, according to data from S&P Capital IQ. That's slower than the growth of 4.9 percent in the second quarter and 5.2 percent in the first quarter.


It will be harder for Wall Street to get an up-to-date view of the economy because the partial government shutdown that began Oct. 1 has kept agencies from releasing key reports on trends like hiring. In general, though, the economy has been expanding this year.


Despite broad confidence that the political parties would strike a deal, the Dow went through rough patches over the last month, at one point falling as much as 900 points below an all-time high reached on Sept. 18. The Dow has seen seven triple-digit moves in the last 10 trading days.


On Wednesday, the Dow Jones climbed 205.82 points, or 1.4 percent, to 15,373.83. The S&P 500 gained 23.48, or 1.4 percent, at 1,721.54. That's only four points below its record close of 1,725.52 set Sept. 18.


The Nasdaq composite climbed 45.42, or 1.2 percent, to 3,839.43.


The feeling among stock traders in recent days was that panicking and pulling money out of stocks could mean missing out on a rally after Washington came to an agreement. Investors have also become inured to Washington's habit of reaching budget and debt deals at the last minute.


"Investors have become, unfortunately, accustomed to some of the dysfunction," said Eric Wiegand, a senior portfolio manager at U.S. Bank. "It's become more the norm than the exception."


In the summer of 2011, the S&P 500 index plunged 17 percent between early July and early August as lawmakers argued over raising the debt limit, and Standard & Poor's cut the U.S. credit rating from AAA, its highest ranking. The market later recovered.


Stocks also slumped in the last two weeks of 2012 as investors fretted that the U.S. could go over the "fiscal cliff" as lawmakers argued over a series of automatic government spending cuts. Stocks rebounded and began a strong rally that has propelled the S&P 500 up almost 21 percent this year.


Some were glad that investors could now turn their focus back to the traditional drivers of the market rather than worrying whether the latest dispatch from Washington would shake stocks.


"It's a little bit silly in the short term for markets to go down so much on press conferences and then to go up so much on rumors," said Brad Sorensen, director of market and sector research at the Schwab Center for Financial Research. "We've urged investors to pull back a little bit and look at the longer term."


The market for U.S. Treasury bills reflected relief among bond investors. The yield on the one-month T-bill dropped to 0.13 percent from 0.40 percent Wednesday morning, an extraordinarily large move. The decline means that investors consider the bill, which would have come due around the time a default may have occurred, to be less risky.


The yield on the 10-year Treasury note edged down to 2.67 percent from 2.74 percent Tuesday. Yields on longer-term U.S. government debt haven't moved as much as those on short-term debt because investors believed that the government would work out a longer-term solution.


Among stocks making big moves:


— Bank of America rose 32 cents, or 2.2 percent, to $14.56 after the second-largest U.S. bank reported a surge in third-quarter earnings.


— Stanley Black & Decker plunged $12.70, or 14.3 percent, to $76.75 after the company lowered its profit forecast for the year, citing slower growth in emerging markets and a hit from the U.S. government shutdown.
